This Acceptable Use Policy ("AUP") defines the rules and guidelines for using the Som application and related services (the "Service"). This policy is incorporated into and forms part of our Terms of Service. Violation of this AUP may result in suspension or termination of your account.
The Service is designed for personal, non-commercial use by individuals of legal drinking age for the purpose of managing wine and spirits collections, logging consumption experiences, and accessing AI-powered sommelier features. You may use the Service to: manage your personal wine and spirits inventory; scan and identify bottles using the AI recognition features; log consumption experiences with tasting notes and ratings; share read-only views of your collection with friends and associates; access AI sommelier analysis for wine selection guidance; and export your collection data for personal use.
You agree not to engage in any of the following activities when using the Service:
Illegal Activities: Using the Service to facilitate the sale, distribution, or promotion of alcohol to minors or in violation of any applicable law, regulation, or licensing requirement. Using the Service in connection with any illegal activity, including but not limited to fraud, money laundering, or trafficking in counterfeit goods.
System Abuse: Attempting to gain unauthorized access to the Service, other user accounts, or related systems and networks. Introducing malware, viruses, worms, or other malicious code. Conducting denial-of-service attacks or deliberately overloading the Service infrastructure. Using automated tools, bots, scrapers, or crawlers to access or extract data from the Service without our express written consent.
Data Misuse: Harvesting, collecting, or storing personal information of other users. Reselling, sublicensing, or commercially exploiting any data obtained through the Service. Using AI-generated scores, reviews, or pricing data to mislead consumers or misrepresent the value of wines or spirits in commercial transactions.
Content Violations: Uploading content that is defamatory, obscene, threatening, or otherwise objectionable. Uploading content that infringes on the intellectual property rights of others. Impersonating any person or entity, or falsely representing your affiliation with any person or entity.
Commercial Exploitation: Using the Service for commercial wine brokerage, auction, or retail purposes without our express written consent. Reselling access to the Service or its features. Using the Service to compile competitive intelligence for a competing product or service.
Our AI-powered features, including bottle scanning, sommelier analysis, and review synthesis, are provided for personal informational purposes. You acknowledge that: AI-generated scores and reviews are estimates and not professional appraisals; pricing estimates are approximate and should not be relied upon for insurance, sale, or investment decisions; AI identification may contain errors, and you should verify important information independently; and AI features consume computational resources, and excessive or abusive use may be throttled.
If you become aware of any violation of this AUP, please report it to [email protected]. We investigate all reports and take appropriate action, which may include warning the violator, suspending access, or permanently terminating the account.
We reserve the right to investigate suspected violations of this AUP and to take any action we deem appropriate, including but not limited to: issuing warnings; temporarily or permanently suspending or terminating accounts; removing content; reporting illegal activities to law enforcement; and pursuing legal remedies. We will endeavor to provide notice before taking enforcement action, except where immediate action is necessary to protect the Service, its users, or third parties.
We may update this AUP from time to time. Material changes will be communicated via in-app notification or email. Your continued use of the Service after such changes constitutes acceptance of the updated AUP.
